Former Maharashtra CM Uddhav Thackeray’s faction has once again reached the Supreme Court and they have challenged the Governor’s invitation to Eknath Shinde faction to form the government. The Uddhav Thackeray camp has also challenged the assembly proceedings held on June 3, where A new president was elected and a floor test was held on 4 June. The Thackeray camp argues that the 16 rebel MLAs against whom disqualification proceedings were pending could not participate in the proceedings of the assembly.
Even before this, Uddhav’s petition was heard on Wednesday evening. During the hearing, the Uddhav Thackeray group accused the governor of being political. Senior advocate Abhishekmanu Singhvi, appearing for Shiv Sena, said that it would be wrong to say that the governor cannot be political. These same governors did not allow 12 members to be nominated for years. It is also necessary to see the office of the governor. The governor did not even talk to any MLA. The governor did not even talk to the chief minister and took a unilateral decision.
‘The governor is not an angel, he is a human being and that is why in the past also there have been court decisions in cases like SR Bommai and Rameshwar Prasad etc.’ ‘Governor’s order to conduct floor test in such a short time is like getting things done in wrong way or wrong order.’
On behalf of Shiv Sena, Singhvi told the court in the rejoinder argument that according to him, the Speaker of the Assembly is always suspicious and political, the Governor is very honest. ‘The MLAs who have switched sides do not reflect the will of the people and if the floor test is not held tomorrow, there will be no calamity.’ “The court should not allow floor test to be conducted until the Deputy Speaker decides on the disqualification petition against the rebel MLAs.” ‘Two NCP MLAs are infected with the corona virus, two Congress MLAs are abroad and they have been asked to take part in the floor test in a day.’
